General conditions of use of the Giris site.

ARTICLE 1 – SCOPE OF APPLICATION OF THE GCU

The following General Conditions of Use (« GCU ») govern the use of the GIRIS site (« the Site ») by any user (« the User »).

By browsing the Site or by using the Application and by performing actions on them, the User recognizes that he/she has read these GTC and accepts them unreservedly.

The Site reserves the right to modify these GCU at any time. The GTUs applicable are always those applicable at the time of the User’s navigation.

ARTICLE 2 – PRESENTATION OF THE SITE AND THE MOBILE APPLICATION

2-1 Purpose of the site

The Site contains information about the Giris brand’s IT service activity.

The Site can be consulted on the Internet at the address https://giris.studio .

2-2 Access and functioning of the site

Access to the site: The User is personally responsible for setting up the IT and telecommunications resources required to access the Site and for the knowledge required to use the Internet and access the Site.

The User shall bear the connection and equipment costs associated with accessing the Internet and using the Site.

2-3 Purpose of the mobile application

The Application is a tool for collecting the User’s personal information in order to create their digital twins which can be used in 3D Environment.

2-4 Limitation of liability of the company

The Site and the Application undertake to ensure that Giris functions correctly, however its liability cannot be incurred for any inconvenience or damage that the User may suffer as a result of using the Site and the Application, or inconvenience or damage inherent in the use of the Internet network, in particular a break in service, external intrusion or the presence of computer viruses.

ARTICLE 3 – PERSONAL DATA

3-1 Information on data collection

The provision of our Service requires the collection and use of personal information.

We inform you below about the personal data collected when using our website or mobile application. Personal data is any data that can be linked to your person, e.g. your name, email addresses, photos, information about your measurements (height, weight), user behaviour.

You must agree to the data collection information in order to use our Digital Twins application.

When you contact us by e-mail or via a contact form, the data you provide will be stored by us in order to answer your questions. We delete the data accumulated in this context when storage is no longer necessary or we restrict processing if there are legal retention obligations.

In connection with the Digital Twins application, it should be underlined that the photos taken in the application will be processed in our technology and used specifically in the production of the photorealistic avatar. Your personal information will be processed and stored by us to create your digital double.

This data is used by Giris, the company responsible for data processing, and will never be transferred to a third party or used for purposes other than those detailed above.

3-2 The rights of users

Users have the right, under the conditions set out in the General Regulation on Personal Data or RGDP (principles partially taken up by the Data Protection Act), to obtain from the Site and the Application:

  • the confirmation as to whether or not personal data relating to them are being processed and, where they are, access to such personal data and information about the processing (right of access);
  • the rectification of their personal data that are inaccurate or that their incomplete personal data be completed (right of rectification);
  • the deletion of their personal data (right to erasure);
  • the limitation of the processing of their personal data (right to the limitation of processing);
  • the receipt of their personal data for transmission to another controller (right to data portability).

They also have the right to object to the processing of their data, under the conditions set out in the GDPR. These rights can be exercised by contacting the following address: contact’@’giris.fr.

Users have the right to lodge a complaint with a supervisory authority.

In accordance with the French Data Protection Act, you may exercise your right to access and rectify your personal data by contacting: the Site or the Application at contact’@’giris.fr.

3-3 Prohibited use of the mobile application

Providing a safe avatar creation service to a large community requires everyone to contribute.

  • You may not impersonate any other person or provide false information. You do not have to reveal your full identity on the Application, but you must provide us with accurate and up-to-date information (including registration information), which may include providing personal data.  You may not impersonate anyone or anything you are not and you may not create an account for another person unless you have their express permission.
  • You may not do anything that is unlawful, deceptive or fraudulent, or act for an unlawful or prohibited purpose.
  • You may not attempt to create accounts or collect or access information illegally. This includes creating accounts or collecting information in an automated manner without our express permission.

3-4 Cookies

The Site and the Mobile Application issue cookies allowing them to:

  • establish statistics and volumes of visits and use of its services (audience measurement cookies);
  • adapt the presentation of the Site according to the terminal used;
  • adapt the presentation of the Site to each user;
  • to memorise information relating to forms filled in on the Site (customer account, order basket, etc.);
  • share information on social networks.

4-1 Rights on the website and on the mobile application

The elements of the Site and the Application are the property of Giris. Some of these elements (for example software, databases, photographs, illustrations, texts, graphic charter or combinations of these elements) may be protected by intellectual property rights, in particular by copyright and trademark law. The disclosure of these elements shall not be interpreted as granting any licence on them or any right other than that of consulting and making personal use of the Site, within the framework of its function.

Any total or partial reproduction of the Site, the Application or its elements without prior written authorisation from the publisher, exposes the offenders to legal proceedings.

4-2 Hypertext links

The Site and the Application may provide links to other websites or other sources of information managed by partner sites. Insofar as the Site cannot exercise any control over these partner services and external sources, it makes no commitment as to the availability and content of these sites and external sources, and declines any responsibility for the content, advertising, products, services or any other material available on or from these sites or external sources. The Site also disclaims any responsibility for any damage or loss, whether actual or alleged, arising out of or in connection with the use of, or reliance on, the content, goods or services available on such partner services or external sources.

The setting up of links to the  https://giris.studio website is not subject to any prior agreement, but the person who sets up the link undertakes to comply with the legislation. Only the explicit mention of the site  https://giris.studio  in the title of the link is required. However, it is advisable to display this site in a new window or a new tab of the browser and not to use the framing technique. However, the Site reserves the right to request the removal of a link that it considers to be in breach of the purpose of the Site (in particular these terms of use), defamatory, counterfeit, parasitic or in breach of its rights or those of third parties.
